ERISA Wraps

ERISA (the Employee Retirement Income Security Act of 1974) is a set of federal laws and regulations that govern welfare benefit plans and qualified retirement plans. Employers must have a written plan document and are required to deliver a summary of it, a Summary Plan Description (SPD), to their participants—regardless of how many employees participate. The SPD is the main vehicle for communicating plan rights to participants. TCO provides the professional preparation of ERISA Wrap plan documents for employers with large and small groups for their welfare benefit plans.

TCO services include:

  • Preparation of wrap or “mega wrap” Plan Document
  • Preparation of Summary Plan Description (SPD)
  • Preparation of Summary of Material Modification  (SMM) with amendment when plan changes are made
  • Guidance on document retention
  • Assistance with employee access and rights
  • ERISA compliance requiring guidance and technical assistance
  • Provide the following notices at the employer’s request: COBRA notice, certificate of creditable coverage, QMCSO procedures, WHCRA annual notice, ARRA election form, and a CHIPRA annual notice.
